Florida is at-will employment state. That means a worker in Florida can be terminated for any reason, just not an “unlawful” reason. What are unlawful reasons for termination of employment in Florida? Any reason that is prohibited by federal or State law. 

For example, Florida has a law called the Florida Civil Rights Act. Supp. 2d 1340, 1352 (S.D. Fla. 2008) (“In analyzing a discrimination claim under the FCRA, courts use the same framework as claims brought under Title VII”)

Unlawful workplace sexual harassment violates federal law (Title VII) and Florida law (the Florida Civil Rights Act). To establish a claim for unlawful sexual harassment by a co-worker (as opposed to a supervisor or owner), a plaintiff must show:

  • That he or she belonged to protected group;

As noted by the Florida case, Speedway SuperAmerica, LLC v. Dupont, 933 So. 2d 75, 80 (Fla. 5th DCA 2006), if the harassment comes from a co-worker, then “the employee must establish that the employer knew or should have known about the harassment and took no (or insufficient) remedial action.”
