Executive & Professional Employment Representation

We are one of the nation’s go-to law firms for representing executives and professionals in important employment law and related business dispute matters, including disputes involving partnership and ownership rights, compensation, equity, “for cause” terminations, severance, employment agreements, and non-compete and non-solicit agreements.

Award Winning Executive & Professional Employment Representation Attorneys

Few firms in the US have our depth of experience in representing c-suite executives and professionals. In fact, many of the executives and professionals who contact us were referred to us by other law firms. We have represented virtually every type of executive position (e.g., CEOs, COOs, CFOs, CIOs, CMOs, VPs, HR Directors, etc.) in virtually every industry. We are also regularly retained by professionals, especially health care professionals (e.g., physicians, dentists, veterinarians), accountants, financial advisors, academics, and other attorneys.

Below are some examples of just a few of the types of matters for which we are retained as legal counsel by executives and professionals.

Employment Agreements, Compensation Agreements, Equity Agreements, & Severance Agreements

Our employment rights attorneys are focused and strategic in ensuring our executive and professional clients are treated fairly by their employer. We regularly review and negotiate crucial employment related agreements and post-employment obligations, including:

  • Employment agreements
  • Partnership agreements
  • Shareholder and operating agreements
  • Equity agreements
  • Independent contractor agreements
  • Bonus and commissions plans
  • Restrictive covenants agreements, including non-competition, non-solicitation, and confidentiality provisions.

Restrictive Covenants (Non-Competes, Non-Solicits, and NDAs)

The depth of experience we have in representing executives and professionals relating to non-compete and non-solicit agreements is perhaps more than any law firm nationwide. We have provided legal guidance on literally thousands of non-compete and non-solicit agreements. It is important you speak with a non-compete employment attorney before signing a restrictive covenant. However, most clients come to us after they have already signed a restrictive covenant and want guidance on what they can or cannot do, as well as how to minimize the chances of litigation.

We also regularly represent high level executives and professionals in litigation involving non-compete and non-solicit defense, including temporary and preliminary injunction hearings. Often these lawsuits will involve many other claims, such as misappropriation of trade secrets and tortious interference. We have attorneys who are leaders in this field of law, and we have a strong record of success.

Executive Compensation

We have substantial experience advising on and successfully litigating disputes involving executive compensation, including equity and equity-like compensation plans. We advise executives and professionals with ownership or ownership like incentives on all types of executive compensation, including deferred compensation and issues under IRC Section 409A and change in control.  If a tax specialist is required, we have state-specific options to which we can refer you.

Contract Disputes

Our executive employment lawyers regularly represent employees in contract disputes. The type of contract disputes we have handled for executives and professionals is too long to list. Just a few examples including disputes concerning “for cause” terminations, commissions and bonuses, restrictive covenants, founder and partnership disputes, and valuation of equity. When possible, we try to negotiate successful resolutions to these matters. When litigation is unavoidable, our clients work with our executive employment litigation attorneys who have substantial experience in trials and arbitrations nationwide.
