Donald C. Tyler has been practicing law in Florida for over 35 years, initially with a nationally known law firm, before serving the United States Equal Employment Opportunity Commission, first as an Administrative Judge, hearing employment discrimination cases brought by Federal employees against Federal agencies, and then as a Trial Attorney in the Commission’s Miami District Office litigating and trying EEOC cases in the United States District Courts for the Southern, Middle, and Northern Districts of Florida. While a Commission Trial Attorney, Don also advised EEOC Investigators regarding the course, direction and legal sufficiency of the factual conclusions of on-going EEOC investigations. Don also served, on a voluntary basis, as the EEOC Miami District Office Union Steward and the Vice President and Delegate to EEOC Local 3599 of the National Council of EEOC Locals 216, where, in 1998, he helped initiate the first ever transition of power from one long-term National Council President into a tradition of representative democracy, with regular, competitive presidential elections.
After thirteen years of service with the Commission, Don spent a decade as Director & Senior Associate Counsel for Litigation, Labor and Employment Law at a major publicly traded cruise line. Next, Tyler served 14 years as Senior Corporate Counsel for Litigation, Labor & Employment Law for a leading publicly traded global manufacturing company. At both companies Tyler directed the corporations’ national and international litigation defense and prosecution in individual actions and class actions involving suppliers, customers, and employees while advising human resources professionals, senior executives and Chief Executive Officers regarding litigation avoidance in the areas of employment law, labor law, contract law, restrictive covenants, antitrust law, data privacy, consumer product protection, and other legal areas.
A native of Cheyenne, Wyoming, a twin, and the sixth of eleven children, (six of whom went to law school); Don always wanted be a lawyer. He graduated from Morehouse College in Atlanta, Georgia, with a B.A. cum laude in Economics and graduated from Harvard Law School in Cambridge, Massachusetts. After graduating from HLS, Don moved to South Florida to begin his legal career.
Don is the father of four young adults, including identical twins, he lives in the Greater Fort Lauderdale Area, and enjoys travel, kayaking, walking, great music and the beach!
REPRESENTATIVE MATTERS
EMPLOYMENT DISCRIMINATION LAW
Assisting clients in the filing and prosecution of EEOC employment discrimination charges.
Conducted an internal investigation of a discrimination harassment complaint brought by a client’s employee resulting in an internal resolution of the issues.
Provided guidance to Human Resources professionals, senior executives and CEOs regarding the investigation and appropriate action with respect to internal sexual harassment complaints brought by company employees.
Provided guidance to Human Resources professionals regarding the interactive process of determining reasonable accommodation in circumstances involving employee disability, pregnancy, and religion.
Provided day-to-day guidance to Human Resources professionals regarding the course and direction of internal company investigations of employment discrimination complaints.
Directed the defense of numerous employment discrimination suits brought by former employees against their former employer.
Provided day-to-day guidance to EEOC Investigators regarding the course and direction of EEOC investigations to ensure that the factual findings were sufficient to support the legal conclusions.
Obtained a plaintiff verdict in the trial of a Title VII disparate treatment case on behalf of a class of women who were denied employment as servers in a renowned Miami Beach restaurant.
Successfully tried a Pregnancy Discrimination case in the United States District Court for the Southern District of Florida on behalf of an automobile aftermarket saleswoman who was discharged by an automobile dealership.
Successfully tried an Age Discrimination in Employment case to full relief in the United States District Court for the Southern District of Florida on behalf of an executive discharged by a national music publishing company.
Successfully prosecuted a Title VII case to full relief on behalf of Americans of Panamanian, Chilean, Cuban, and Puerto Rican national origins who were discharged because of their national origins by a Nicaraguan company doing business in Miami Florida.
Obtained a complete plaintiff verdict through a motion for summary judgment in the U.S District Court for the Middle District of Florida in an Age Discrimination in Employment case against a school board.
EMPLOYMENT LITIGATION
Provide assistance to clients in obtaining unpaid commissions.
Directed successful resolution of two California Labor Code class action lawsuits.
Directed the successful resolution of a number of Fair Labor Standards Act employee mis-classification matters.
LABOR LAW
Assisted with the interpretation of numerous United States and Canadian collective bargaining agreements.
Assisted in the negotiation of several collective bargaining agreements with numerous international seamen’s unions.
RESTRICTIVE COVENANTS, NON-COMPETES AND TRADE SECRETS
Provide day-to day guidance to clients who are parties to restrictive covenants agreements.
Provided day-to-day guidance to Human Resources professionals and senior executives regarding the drafting and interpretation of non-competition agreements, the potential employment of individuals formerly employed by competitors, and the employment by competitors of former employees.
Successfully litigated the resolution of a suit against a former employee who became employed in a non-competitive capacity by a major competitor.
